These General Terms and Conditions of Sale (GTC), along with the privacy policy of the website www.sakuraheadspa.com, referred to as Sakura Head Spa, define the conditions applicable to sales concluded between, on the one hand, the individuals wishing to purchase a product sold by Sakura Head Spa, hereinafter referred to as "Client," and, on the other hand, "Sakura Head Spa," which is an online store operating on the internet and owned by the company Glamour Lab Ltd, a limited liability company (registration number 64573289), whose registered office is located at the following address: Room 1801, Easy Comm. Building, 253-261 Hennessy Road, Wanchai, Hong Kong Island, Hong Kong SAR.

By placing an order, the Client expressly accepts these GTC and the privacy policy as an integral part of the contract.

The following conditions apply exclusively to all deliveries and services provided by Sakura Head Spa. The Client’s conditions that are contrary or divergent from our GTC are not recognized. Any additional agreement or commitment made by Sakura Head Spa requires written form. Sakura Head Spa expressly reserves the right to modify these GTC at any time.

1- PRICE OF ITEMS

The prices listed on the website are in Euro (EUR).

For delivery within the European Union, VAT and any possible customs duties are included in the sale price (inclusive of tax).

For delivery to other countries (all countries not listed in section 2), VAT and customs duties are not included in the sale price. The listed sale price is the "ex-tax" price (excluding VAT).

For deliveries to the countries listed in section 3, the Client is solely responsible for the duties and taxes imposed by their country when the goods pass through customs. These fees are not covered by Sakura Head Spa.

The reference price of an item is the one published on the Sakura Head Spa website at the time of the order.

Prices may be modified on the website without prior notice and are not retroactive.

2- ORDER

The client can place an order on the website at any time.

If any additional costs/fees are necessary (for example, in the case of special executions), the Client will be contacted directly by Sakura Head Spa; a new invoice will be issued as a supplement if necessary.

Sakura Head Spa reserves the right to refuse or cancel an order with a Client in case of a dispute regarding previous payment or if Sakura Head Spa considers that the Client represents a risk.

3- AVAILABILITY

The offers of products and prices from Sakura Head Spa are valid as long as they are visible on the website and within the limits of available stock.

Sakura Head Spa undertakes to supply the items ordered within the limits of available stock. If the item is no longer available, the Client will be informed as soon as possible by Sakura Head Spa. The new availability dates of the product will then be communicated to the Client. If the Client wishes, they can cancel or modify their order.

The availability information provided at the time of ordering is given as an indication only, as products are not reserved until payment for the order is made. Orders awaiting late payment after the order has been placed may result in changes or unavailability of the stock of the ordered product(s).

4- PROMOTIONAL OFFERS

The terms of Sakura Head Spa's offers (validity dates, affected items, and the offer) are indicated on each promotion.

These offers are valid within the limits of available stock.

A benefit offered in the form of a discount or gift is valid only once, on a single order.

Sakura Head Spa's offers are in no way refundable in cash.

If the Client has a promotional code, they must enter it in the designated field in the shopping cart to benefit from their personal advantages.

5-RIGHT OF RETURN

If any of our "in stock" items do not meet the Client's expectations (hair rituals or hair massage and diagnostic accessories), the Client can return them to Sakura Head Spa within 30 days of receiving the package. To ensure that the return is accepted, the Client must inform Sakura Head Spa of the reasons for the return of the merchandise. After this step, it is imperative that the returned items show no signs of wear and are returned in their original packaging without any damage.

Already paid items will be refunded by bank transfer or exchanged according to the Client's request (once the return has been validated by Sakura Head Spa).

Delivery fees and any customs fees related to the return of merchandise are the responsibility of the Client and will not be charged to Sakura Head Spa.

For made-to-order products (including Head Spas), the following conditions will apply:

If the Client finds that the delivered product has a defect, they must immediately inform Sakura Head Spa by email at bonjour@sakuraheadspa.com, specifying the reasons why they believe the product does not conform to their order.

If Sakura Head Spa finds that the product indeed has an issue and if rectification or a new delivery is impossible, the Client will have the option to be refunded the amount of their order.

6-WARRANTY

All our products come with a one-year warranty.

This warranty against any manufacturing defects starts from the date of delivery of the products.

The Client must inspect the delivered goods upon receipt to exclude any obvious material defects and damages caused during transport.

Any service or repair performed on your product purchased from Sakura Head Spa must be carried out by Sakura Head Spa's authorized repair partners. If this condition is not met, the international warranty of your product will no longer be valid.

The following are not covered by this warranty:

  • Incorrect use of the products and failure to follow the usage instructions
  • Normal wear and tear of the product and its deterioration over time
  • Damage caused by improper use

7-DELIVERY AND SHIPPING

Sakura Head Spa delivers its products worldwide through internationally recognized carriers.

Delivery fees are free within the EU, the United States, and the United Kingdom. For other countries, shipping fees are indicated on the website during the order process or can be clarified upon request by our customer service.

Once the goods are ready for shipment, the delivery time for in-stock products is 3 to 5 days. For "made-to-order" products (including Head Spas), allow approximately 6 to 8 weeks.

Once the goods have been shipped, the Client can track the progress of their delivery using the "TRACKING" number provided in the shipping confirmation email.

8- PAYMENT METHOD

Regardless of the payment method (by credit card, debit card, or bank transfer), the transfer of ownership only occurs once full payment has been received into the account associated with the Sakura Head Spa website.

9- SEVERABILITY CLAUSE

In the event that individual provisions of these GTC are or become entirely or partially invalid or unenforceable, the remaining provisions shall not be affected. The contracting parties agree to replace the invalid provision with a valid legal provision whose content and economic objective are as close as possible to the original intent of the invalid provision.

Modifications and additions to these GTC require written form to be valid (e.g., fax or email). The same applies to modifying the requirement of written form itself. Sakura Head Spa is free to modify these GTC at any time. The contractual version of the GTC at the time of the sale can be consulted and printed from the website at the same time as the sale date.

10- CHOICE OF APPLICABLE LAW AND JURISDICTION

The competent courts and jurisdictions are those of France.

French law relating to online sales applies, excluding the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980.
